ContributeWhen a non-Aboriginal woman married in the nineteenth century, she delivered herself, any property or earnings (present or future) and any children into the control of her husband. Paradoxically, this was her best chance of ensuring economic survival and social adulthood. Colonists were more concerned with the issues of who might perform marriages and with civil registration than with women’s rights. Marriage and a bourgeois model of family life were central to Edward Gibbon Wakefield’s plan for the colony, but so too was denominational equality. Only Church of England clergy could formalise marriages initially, but the colony’s first Marriage Act 1842 extended authority to clergy of the Church of Scotland, to other Protestant ministers and to rabbis, who were required to seek a licence for each marriage performed. Priests of the Roman Catholic Church acquired the same right in 1844. Civil registration was also instituted in 1842, and previous marriages were retrospectively legalised. The scarcity of clergy prompted Marriage Acts in 1852 and 1867 that allowed for civil marriage. With no minimum age specified, minors could marry with the permission of their parents. The Deceased Wife’s Sister Act 1870, permitting a widower to marry his sister-in-law, was an ongoing controversy: the crown disallowed the four bills passed by the South Australian parliament on this matter from 1857. Marriage to one’s deceased husband’s brother was legalised in 1925.
The mid-nineteenth century
During the nineteenth century the marriage rate fluctuated, falling steeply with the male exodus to the gold rushes in the early 1850s and again with the economic depressions of the 1870s and 1890s. The proportion of those never married grew steeply at the end of the nineteenth century, reaching peaks of 18.6% of men aged 45–49 years in 1901 and 17.3% of women aged 45–49 years in 1921.
When male desertion of families increased during the gold rushes, the Matrimonial Causes Act 1858 extended facilities for divorce and judicial separation. Whereas men need cite only one ground for divorce, women had to prove both adultery and either cruelty or drunkenness. Further legislation in 1867 protected the property of divorced wives and clarified procedures. The first attempt to protect married women’s property failed in 1872, but under the Married Women’s Property Act 1883–84 a woman gained ‘financial personage’, right to her own property and earnings as well as the responsibility to maintain her relatives, including her husband, if they were destitute.
Efforts to liberalise divorce law in 1889 were opposed by various groups including the Woman’s Christian Temperance Union. But women who were being cruelly treated could gain some relief by leaving the marital home and applying for maintenance from their husbands under the Destitute Act 1881. While this remedy was closed off in 1892, the Married Women’s Protection Act 1896 allowed a woman to apply to a magistrate to release her from living with her husband and make orders allowing for her protection, custody of the children and maintenance if he found the husband guilty of cruelty, desertion or adultery or of failing to make adequate provision for the wife and children. Between 1859 and 1899 there was an annual average of only 9.9 applications for divorce or judicial separation, between 1908 and 1918 the rate rose to a yearly average of 21.6 applications.
Mothers and children
With the Infant’s Custody Act 1883–84 a woman could apply to a court to over-ride paternal authority and grant her custody and maintenance of her children. The Guardianship of Infants Act 1887 allowed a woman to be guardian of her children in the event of her husband’s death. The Women’s Non-Party Political Association urged equal custody rights from 1909, with legislation to this end finally enacted in 1940. It was only in 1918 that grounds for divorce were made the same for men and women: the single ground of adultery. Feminist groups sought equality in relation to other aspects of marriage. Men could will their assets away from their wives and children, but the Testator’s Family Maintenance Act 1918 aimed to ensure adequate provision for wife and children.
Crude marriage rates fell sharply during the Great Depression (1927–39) to a low of 5.3:1000 in 1931 but rose thereafter to 8.8 in 1936 and 11.4 in 1941. In the second half of the century they fluctuated, falling to 7.8 in 1981, 6.5 in 1991 and 5.5 at the end of the century. The age at marriage decreased from mid century: 48% of brides and 16% of grooms were under 21 years in 1971. Curiously, it was only with the Marriage Act Amendment Act 1957 that a minimum marriage age was established (16 years for women and 18 years for men).
Divorce and separation
But as marriage grew, so too did the possibilities for divorce. The Matrimonial Causes Amendment Act 1938 legalised divorce after a five-year separation and the Commonwealth Matrimonial Causes Act 1959 established uniform federal legislation, including new grounds for divorce, viz, desertion for three years or separation for five years.
Between 1911 and 1975 the divorce rate grew slowly from 0.03:1000 to 1.8:1000, with a sharp rise during the 1940s. Wives initiated approximately 36% of petitions in 1911–15 and 61% by 1971–75. With the Commonwealth Family Law Act 1975 allowing for no-fault divorce after the irretrievable breakdown of marriage, the rate increased four-fold in 1976 but subsequently subsided. In 1999 the divorce rate was 2.8:1000. Re-marriage and second divorces became more common.
The last quarter of the twentieth century saw marked changes in marriage and divorce. The Criminal Law Consolidation Act 1975 enabled a further development of married women’s legal rights by permitting husbands to be charged with rape or indecent assault. From 1979 the crude marriage rate fell from 7.6 to 5.5 in 1999, while the average age of first marriage rose from 25 to 28.1 years for grooms and from 22.4 years to 26.2 years for brides. In 1999, 70% of marrying couples had lived together before marriage and 61% had a civil celebrant. An increasing number never marry. The total fertility rate was at a low 1.7 per woman, and almost one-third of births occurred outside wedlock. While many women made financial contributions to the household, well into the mid twentieth century married men were expected to be the family breadwinner. But couples have increasingly assumed a joint economic responsibility, and on divorce women are entitled to a share in marital property. Federal legislation in the 1990s enforced the requirement that non-custodial parents provide financial support for their children.
Indigenous South Australians
Indigenous marriage practices were little known by settlers nor recognised as legal by officials. Protection policies required Aboriginal people to seek permission to marry. Marriage to a white man could mean that an Aboriginal woman lost any rights to assistance from the state as an Aboriginal person but did not qualify as a white person. The identity of an Aboriginal man marrying a white woman was not similarly affected. Aboriginal and white men in legal or de facto marriages with Aboriginal women were not guardians of their children, who could be taken away by state authorities. Under the Aborigines Act 1911 the protector of Aborigines was made the legal guardian of all Aboriginal and ‘half-caste’ children under 21 years. The state’s failure to recognise Indigenous marriage meant that children born of these marriages were deemed illegitimate and their mothers therefore were not able to claim the child endowment introduced by the federal government from 1941.

You've been doing a lot of research there! I'm not sure about legal protection from the newspaper notice, you may need to consult a lawyer on that one, but since before the married women's property act a woman's property went to her husband it is reasonable to assume debt would as well. Your theories about the involvement of Elizabeth's sons also sounds reasonable, but without records of her bank loans and debts it's impossible to say for sure. Dear Ms Allen I was wondering if you could help me with a number of questions concerning the status of married women in 19th century South Australia. I have tried to find the answers myself, but to no avail, but then I came across this website during my research.
I am researching my Great Great Grand Parents Edward Atkins and Elizabeth Mashford. Both people separated, but there was no divorce. In November 1872, Elizabeth Atkins purchased five blocks of land at Gladstone SA. On 30 August 1873, Edward Atkins placed a notice in the newspapers stating he would not be responsible for his wife’s debts. I understand that under the SA Married Women’s Property Act 1883/1884 women in SA could for the first time hold, and dispose of any real or personal property. Before this Act, a married women’s property legally belong to the husband. I also understand that married women could not enter into a legal contract without her husband’s approval. However, would I be right in saying that before 1883/1884 the husband could be responsible for his wife’s debt? Would this be the reason as to why Edward Atkins placed the notice in the newspaper? Would such a notice back in the 1800s give Edward Atkins any legal protection if his wife could not pay her debts?
Secondly, I am having real problems in finding out any information regarding the status of women and banking in South Australia in the 1800s. I am under the impression that women could not enter into a legal contract without her husband approval before 1883/1884. Am I right in my thinking? If so, how did Elizabeth Atkins a married, but separated, women buy land under her own name? because she would have to enter into a contract unless she lied. Do not be worried if you have to tell me my GGGmother was a liar because it would not surprise me. She may have married Edward Atkins while her first husband was still alive and I believe that caused the separation.
Furthermore, If she did not have the cash she would have to borrow the money from a Bank. I am under the impression because there were no anti-discrimination laws that Banks could deny married women from opening up their own accounts in the 1800s. Would my thinking be right in this regards? I am also under the impression she would have to lie to the Banks to secure any loan.
Want is interesting about the certificate of title I have in regards to the land is in 1886 she transferred a block of land to her son George Lewis and I have copies of the Gladstone council assessment rates which show her other son, John Mashford Lewis , is paying council rates for another block of land which she owned. As a result, could it be possible that she never took out a Bank loan, but instead, her two sons took out the loan and as repayment, Elizabeth Atkins transferred some of the blocks of the land?
Any suggestion you have would be most helpful. I do have a copy of Helen Jones’ book “In her own name,” and Henry Finlay book about divorce in Australia 1858-1975. However, these books do not seem to cover in any details the information I am seeking. Are you able to recommend a good book on the history of women’s right in South Australia ,or a journal article, which covers the information I am seeking.

I'm afraid I don't know a simple answer to that question Masha, it would be a good idea to look at statistics of birth rates in times of 'bust and boom' economically to see if you can find a trend there that explains your statement. There are also many good social history books that deal with the gold rushes in Australia, you could start with something like 'The Rush That Never Ended' by Geoffrey Blainey, or 'Boom : the underground history of Australia, from Gold Rush to GFC' by Malcolm Knox.
My question is: Why did marital couples have a lot of children during the gold rush?
Is it possible someone could answer me ASAP because I've got to do a test in 2 days?

Current Commonwealth marriage law of course places a clear and weighty burden on the marriage celebrant to establish the identities of the parties to the marriage, including names and dates of birth. The preferred source is the birth certificate, and in general there must be appropriate documentation if a party wishes to use another form of their name. Similarly there are procedures to be used, and recorded, if birth certificates and subsequent documentation of name changes are not available.
My question is: how was the verification of identity and birth details handled in South Australia in the early 1940s? Same or similar? In deviant cases would there be a record of documents used apart from birth certificates?

My grandfather divorced my grandmother in 1918. They were residents of NSW but the divorce notice was published in the Adelaide Times. Not sure why but may be that the Anglican Church in NSW did not allow divorce? Was it possible for a New South Welshman/woman to get a legally recognized divorce in another state?
